This essay focuses on a recently prominent notion of ground which is distinctive for how it links metaphysics to explanation. Ground is supposed to serve both as the common factor in diverse in virtue of questions as well as the structuring relation in the project of explaining how some phenomena are “built” from more fundamental phenomena. My aim is to provide an opinionated synopsis of this notion of ground without engaging with others. Ground, so understood, generally resists illumination by appeal (...) to more familiar models of explanation. Nevertheless, its distinctive explanatory and metaphysical aspects guide us on characterizing its explanatory logic and its metaphysical features. Some issues concerning the meta-question of what grounds ground are explored, as well as some recent skeptical challenges to ground. (shrink)

The influential public health ethics framework proposed by Childress et al. includes five “justificatory conditions,” two of which are “necessity” and “least infringement.” While the framework points to important moral values, we argue it is redundant for it to list both necessity and least infringement because they are logically equivalent. However, it is ambiguous whether Childress et al. would endorse this view, or hold the two conditions distinct. This ambiguity has resulted in confusion in public health ethics discussions citing the (...) Childress et al. framework, as demonstrated by debate between Resnik and Wilson and Dawson. We analyse this debate to resolve these ambiguities. Finally, we argue that the necessity/least infringement principle of the Childress et al. framework applies only in cases in which only one intervention is to be implemented to achieve one specific goal. In other cases, it is not essential to require that only the least infringing intervention be implemented. (shrink)

In this paper we discuss ethical implications of the use of mobile phone apps in the control of the COVID-19 pandemic. Contact tracing is a well-established feature of public health practice during infectious disease outbreaks and epidemics. However, the high proportion of pre-symptomatic transmission in COVID-19 means that standard contact tracing methods are too slow to stop the progression of infection through the population. To address this problem, many countries around the world have deployed or are developing mobile phone apps (...) capable of supporting instantaneous contact tracing. Informed by the on-going mapping of ‘proximity events’ these apps are intended both to inform public health policy and to provide alerts to individuals who have been in contact with a person with the infection. The proposed use of mobile phone data for ‘intelligent physical distancing’ in such contexts raises a number of important ethical questions. In our paper, we outline some ethical considerations that need to be addressed in any deployment of this kind of approach as part of a multidimensional public health response. We also, briefly, explore the implications for its use in future infectious disease outbreaks. (shrink)

In _The Immorality of Punishment_ Michael Zimmerman argues forcefully that not only our current practice but indeed any practice of legal punishment is deeply morally repugnant, no matter how vile the behaviour that is its target. Despite the fact that it may be difficult to imagine a state functioning at all, let alone well, without having recourse to punishing those who break its laws, Zimmerman makes a timely and compelling case for the view that we must seek and put (...) into practice alternative means of preventing crime and promoting social stability. This paper raises a problem for the pair of views that universals are immanent in their instantiations and that these instantiations, or states of affairs, are somehow constructed from the instantiated universals. It is argued that the pair is inconsistent. The first view implies that universals are prior to states of affairs, whereas the second view implies that states of affairs are prior to universals. This paper does not attempt to solve this problem, but rather to formulate it precisely. Workplace spirituality research has sidestepped religion by focusing on the function of belief rather than its substance. Although establishing a unified foundation for research, the functional approach cannot shed light on issues of workplace pluralism, individual or institutional faith-work integration, or the institutional roles of religion in economic activity. To remedy this, we revisit definitions of spirituality and argue for the place of a belief-based approach to workplace religion. Additionally, we describe the construction of a 15-item measure of workplace religion (...) informed by Judaism and Christianity – the Faith at Work Scale (FWS). A stratified random sample (n = 234) of managers and professionals assisted in refining the FWS which exhibits a single factor structure (Eigenvalue = 8.88; variance accounted for = 59.22%) that is internally consistent (Cronbach’s α = 0.77) and demonstrates convergent validity with the Faith Maturity Scale (r = 0.81, p > 0.0001). The scale shows lower skew and kurtosis with Mainline and Catholic adherents than with Mormons and Evangelicals. Validation of the scale among Jewish and diverse Christian adherants would extend research in workplace religion. (shrink)

Recent work in both the theory of the firm and of corporate law has called into question the appropriateness of analysing corporate law as ‘merely’ a set of standard form contracts. This article develops these ideas by focusing on property law's role in underpinning corporate enterprise. Rights to control assets are a significant mechanism of governance in the firm. However, their use in this way predicates some arrangement for stipulating which parties will have control under which circumstances. It is argued (...) that ‘property rules’—a category whose scope is determined functionally—protect the entitlements of parties to such sharing arrangements against each other's opportunistic attempts to grant conflicting entitlements to third parties. At the same time, the legal system uses a range of strategies to minimize the costs such protection imposes on third parties. The choice of strategy significantly affects co-owners’ freedom to customize their control-sharing arrangements. This theory is applied to give an account of the ‘proprietary foundations’ of corporate law, which has significant implications for the way in which the subject's functions are understood and evaluated. The debate over corporate moral responsibility has become a fixture in business ethics research and teaching. Only rarely, however, does the sizable literature on that question consider whether the debate has important practical implications. This article examines that question from a corporate control perspective. After assuming corporate moral responsibility’s existence for purposes of argument, the article concludes that such responsibility makes a difference in cases where it is present but personal responsibility is absent. Then the article tries to identify the (...) forces that diminish personal responsibility when corporate responsibility exists. The most important such forces, it concludes, spring from the socialization processes people undergo when they enter groups. One example is the well-known phenomenon of groupthink, which can exculpate individuals by rendering them justifiably ignorant of foreseeable risks of harm. (shrink)

Bovine tuberculosis is an important animal health policy issue in Britain, which impacts farmers, the public, domestic farmed cattle and the wild badger population. The Westminster government’s badger culling policy in England, which began in 2013, has caused considerable controversy. This is in part because the Independent Scientific Group advised against culling, based on the Randomised Badger Culling Trial. Those opposed to badger culling support more stringent cattle-based measures and the vaccination of badgers. This paper argues for ethical analysis of (...) public policy options which impact sentient species. It provides a summary Animal Welfare Impact Assessment of a do-nothing approach, badger culling, and badger vaccination. A utilitarian analysis is then applied to these policy options considering human wellbeing and animal welfare. The analysis compares a badger culling policy that achieves a 19% reduction in bovine TB incidence, a badger vaccination model achieving a 12.5% reduction, and a do-nothing approach. Policy options are assessed over 9 years and a longer timeframe, and uncertainty is considered. The analysis finds that non-culling approaches, particularly badger vaccination, result in greater total utility, compared to badger culling. Badger culling causes 30% reduction in the badger population in England as well as substantial harms due to the culling process. Culling is opposed by public opinion and is associated with considerable risks and uncertainty. In contrast, non-culling approaches, such as cattle-based measures and badger vaccination, are supported by public opinion and are not associated with such risks. (shrink)

Despite some exceptions, the business ethics literature on the moral responsibility of corporations does not emphasize a subject critical to that inquiry: the general nature of corporations. This article attempts to lessen the imbalance by describing three conceptions of the corporation that have been prominent in twentieth century legal theorizing, and by sketching their implications for the moral responsibility of corporations. These three conceptions, at least two of which have counterparts in the philosophical and organizational theory literature, are the concession, (...) aggregate, and real entity theories. The article concludes that the real entity theory is the most plausible of the lot. At least under prevailing tests of moral responsibility, it then contends, corporations-as-real-entities are morally responsible for most of their members' actions. (shrink)

We agree with Rachlin's aim to account for altruism within existing theory. However, his argument is implicitly dependent on social and cognitive constructs that are explicitly identified in other social-psychological theories. The account does not advance theory beyond available constructs (e.g., self-categorizations, motives, values, role-identities, and social structure), and Rachlin's implicit use of these strains the behaviorist account.

Simon Evnine’s Making Objects and Events: A Hylomorphic Theory of Artifacts develops amorphic hylomorphism. I critically discuss three of its main themes. One theme is its attempt to do the work of form without forms. A second theme is the requirement that hylomorphs have ‘metabolisms at work’. A third theme is the use of artifacts as the paradigms for hylomorphs. I will raise some criticisms of each of these themes. Although the themes might at first appear disconnected, I believe the (...) third underwrites the first two. So the criticisms of the third theme also bear on the rest. (shrink)

Thoughts of mortality sometimes bring on a crisis in confidence in the meaning in one's life. One expression of this collapse is the midlife crisis. In a recent article, Kieran Setiya argues that if one can value activities as opposed to accomplishments as the primary goods in one's life then one might avoid the midlife crisis. I argue that Setiya's advice, rather than safeguarding the meaning in one's life, substitutes for it something else, a kind of happiness. I use Susan (...) Wolf's concept of meaning in order to make this case. Wolf has not written much about the importance of death, but I argue that her account of meaning shares essential features with the theories developed by Jean-Paul Sartre and Martin Heidegger. Sartre argues that death is an unqualified harm, while Heidegger argues that there is meaning in life only because we are mortal. I conclude by showing how Heidegger's theory of mortality underwrites accounts of meaning like those found in Wolf. (shrink)

How do we and should we decide what is morally right and what is morally wrong? For much of human history, the teachings of religion were presumed to provide either the answer, or much of the answer. Over time, two developments challenged this. The first was the establishment of the discipline of moral philosophy. Foundational texts, such as Immanuel Kant's Groundwork of the Metaphysics of Morals, and the growth of coherent, nonreligious approaches to ethics, notably utilitarianism, served to marginalize the (...) role of religion. And then, second, the twentieth century saw the rapid growth of evolutionary biology with an enthusiastic presumption that biology was the source of ethics. Here, I begin by discussing these developments and then examine the extent to which religion is still needed for a coherent account of ethics. (shrink)

Until recently, little attention has been paid in the school classroom to creationism and almost none to intelligent design. However, creationism and possibly intelligent design appear to be on the increase and there are indications that there are more countries in which schools are becoming battle-grounds over them. I begin by examining whether creationism and intelligent design are controversial issues, drawing on Robert Dearden's epistemic criterion of the controversial and more recent responses to and defences of this. I then examine (...) whether the notion of ‘worldviews’ in the context of creationism is a useful one by considering the film March of the Penguins. I conclude that the ‘worldviews’ perspective on creationism is useful for two reasons: first it indicates the difficulty of using the criterion of reason to decide whether an issue is controversial or not; secondly, it suggests that standard ways of addressing the diversity of student views in a science classroom may be inadequate. I close by examining the implications of this view for teaching in science lessons and elsewhere, for example in religious education lessons and citizenship lessons and at primary level where subject divisions cannot be made in so clear-cut a manner. This work contains newly translated excerpts from Samuel Pufendor's two major works in political and moral thought, Elements of Universal Jurisprudence and The Law of Nature and Nations. The editor and translator have worked to present a readable and comprehensive introduction to Pufendorf's political philosophy. The new English translation far exceeds what is currently available in terms of sophistication and clarity. A substantive introduction is included to acquaint readers with Pufendorf's ideas.

In this paper, I discuss the role of Anselm’s ontological argument in the philosophy of R.G. Collingwood. Anselm’s argument appears prominently in Collingwood’s Essay on Philosophical Method (1933) and Essay on Metaphysics (1940), as well as in his early work Speculum Mentis (1924). In the proof, Collingwood finds the central expression of the priority of “faith” in the first principles of thought to reason’s activities. For Collingwood, it is Anselm’s proof that clearly expresses this relationship between faith and reason. The (...) two elements of this analysis that must be understood if one is to understand Collingwood’s use of the proof are what he means by “the idea of an object that shall completely satisfy the demands of reason” and the “special case of metaphysical thinking.” I analyze both of these elements and conclude by showing how Anselm’s proof is essential to Collingwood’s historical science of mind. When phylogenetic trees constructed from morphological and molecular evidence disagree (i.e. are incongruent) it has been suggested that the differences are spurious or that the molecular results should be preferred a priori. Comparing trees can increase confidence (congruence), or demonstrate that at least one tree is incorrect (incongruence). Statistical analyses of 181 molecular and 49 morphological trees shows that incongruence is greater between than within the morphological and molecular partitions, and this difference is significant for the molecular partition. Because the (...) level of incongruence between a pair of trees gives a minimum bound on how much error is present in the two trees, our results indicate that the level of error may be underestimated by congruence within partitions. Thus comparisons between morphological and molecular trees are particularly useful for detecting this incongruence (spurious or otherwise). Molecular trees have higher average congruence than morphological trees, but the difference is not significant, and both within- and between-partition incongruence is much lower than expected by chance alone. Our results suggest that both molecular and morphological trees are, in general, useful approximations of a common underlying phylogeny and thus, when molecules and morphology clash, molecular phylogenies should not be considered more reliable a priori. The UK launch of the Science Enterprise Challenge in 1999 has stimulated interest in the evolutions of science-based firms and this paper argues that Popper’s seminal diverse contributions to philosophy are directly relevant to them. It begins by commenting on the applications of both Kuhn’s and Popper’s concepts to technological (as against) scientific evolutions. It then suggests how Popper’s approaches are applicable to the development and assessment of new technology within the framework of Freeman’s stakeholders approach. McKay & Dennett (M&D) convincingly argue against many proposals for adaptively functioning misbelief, but the conclusion that true beliefs are generally adaptive does not follow. Adaptive misbeliefs may be few in kind but many in number; maladaptive misbeliefs may routinely elude selective pruning; reproductively neutral misbeliefs may abound; and adaptively grounded beliefs may reliably covary with but not truthfully represent reality.

Sociobiology is the scientific study of why organisms sometimes associate with other organisms. This paper surveys recent research on the reasons for altruism and aggression. It also considers the contributions an individual's genes and its environment make to its behavior, and it reviews functional theories for the evolution of cannibalism, polygamy, homosexuality, and infanticide in humans and other animals. Finally mention is made of the limited and generally negative attitude of sociobiology to religion.

Should research on the possible genetic components of human intelligence be carried out? I first try to provide some general guidelines as to whether any particular piece of research should be undertaken and then consider the specific example of the ethics of genetic research on intelligence. The history of the debate on intelligence does not make one very optimistic that the fruits of such research would be used wisely. However, there are indications that people’s understanding of the nature of inheritance (...) may be improving and it could be that such research might have significant benefits. It is worth remembering than the condition phenylketonuria, a genetic disease in any useful sense of the term, and one that leads to mental retardation (i.e. very low intelligence), is now wholly preventable, and indeed very largely prevented, through environmental intervention. This is a short note on the limits of Varieties of Capitalism and the potential of the Keynes-Kalecki approach proposed by Baccaro and Pontusson for overcoming them. It identifies the main problem as a failure to define capitalism itself. This effectively reduces the approach to a comparison of the U.S. and German economies at the end of the 20th century. It is in particular unable to recognize let alone explain the very different U.S. economic system in the immediate postwar decades (...) or how the more recent emphasis on the market emerged to take its place. The promise of the Keynes-Kalecki approach is that it will overcome these limits, but the promise has not yet been realized. (shrink)

We argue that the strengths of the Theory of Event Coding (TEC) can usefully be applied to a wider scope of cognitive tasks, and tested by more diverse methodologies. When allied with a theory of conceptual representation such as Barsalou's (1999a) perceptual symbol systems, and extended to data from eye-movement studies, the TEC has the potential to address the larger goals of an embodied view of cognition.
